Abstract

This research is motivated by the fundamental differences between Indonesian positive law, which grants freedom in making wills under the Civil Code (KUHPerdata), and Minangkabau customary law, which adheres to a matrilineal system, particularly in the management of pusaka tinggi (ancestral property). The main issues examined are the validity of wills from the perspective of Minangkabau’s matrilineal principles and the resolution of inheritance disputes when wills conflict with this system. The objectives of this study are to analyze the legal validity of wills in the context of Minangkabau customary law, explain the role of the mamak (maternal uncle) as a customary authority, and examine the potential conflicts between customary law and national civil law. This study employs a normative juridical method with a descriptive nature, using a conceptual approach, literature review, and interviews with customary leaders. The theoretical framework includes the concepts of customary law, inheritance law, and the principles of customary succession. The findings show that in Minangkabau society, the validity of a will is strongly dependent on compliance with matrilineal principles, particularly regarding pusaka tinggi, which cannot be individually inherited. Conflicts between customary law and civil law often arise when wills disregard these principles, with dispute resolution typically conducted through family deliberation or the intervention of customary leaders. This research concludes that harmonization between customary law and positive law is necessary to ensure legal certainty and justice for customary communities.
