Abstract

Child protection is a mandatory matter in Indonesian law, therefore, children in conflict with the law are legal subjects who require special treatment, considering that they do not yet have the psychological and social maturity of adults. This study aims to determine the form of legal protection provided to children against perpetrators of theft followed by violence, as well as to analyze the application of statutory provisions in Decision No. 2/Pid.Sus-Anak/2021/PN. Bks. The research method used is normative juridical with a statute approach and case studies, and supported by an analysis of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The author also uses observational collection techniques, namely by observing and recording through internet media or websites. This technique is carried out by observing phenomena that occur in society. In legal research, observation is used to analyze the effectiveness of a statutory regulation. In the decision, legal protection for children in conflict with the law is divided into two main forms, namely preventive protection and repressive protection. These two forms of protection have complementary roles to ensure that children continue to receive their rights and receive appropriate humane treatment so that the decision imposes a prison sentence of being placed in a Special Child Development Institution (LPKA) while still taking into account the best interests of the child.
