Abstract
The research answers the problem of determining the LSD in the conversion of non- agricultural land functions related to the spatial and regional planning of Klaten Regency and formulates the concept of legal efforts regarding the determination of protected rice fields (as LSD) in the conversion of non-agricultural land functions against the spatial and regional planning of Klaten Regency. The determination of LSD in the Regency Government area has an impact on legal uncertainty. If designated non-agricultural land is regulated differently in the Regional Spatial Planning and Regional Planning Regulations, the government determines LSD based on satellite imagery maps by optimizing the development of digital technology. The goal is to create security and minimize the conversion of non-agricultural land that does not comply with laws and regulations. In fact, this policy has resulted in losses for non-agricultural land conversions that comply with laws and regulations but are then designated as LSD. The parties who carried out the transfer of function experienced material losses and legal uncertainty considering that the agreement had been made and regarding the determination. This research is normative, using primary and secondary legal materials analyzed through a statutory approach and a conceptual approach. The results of the study are the problems of determining LSD in the conversion of non-agricultural land functions related to spatial and regional planning in Klaten Regency, including the legal and economic impacts of determining LSD on parties who have contracts, problems of harmonization and synchronization between legislation that determines LSD and legislation that regulates the conversion of non-agricultural land functions, there has been no follow-up in the preparation of regional regulations that regulate the prohibition of conversion of LP2B and LBS functions, and the lack of technical aspects that regulate the implementation of conversion of non-agricultural land functions. The concept of legal efforts against the determination of LSD in the conversion of non-agricultural land functions against the spatial and regional planning of Klaten Regency includes preventive legal efforts in the form of requests for re-registration and matching of LSD determinations in the conversion of non-agricultural land functions, and civil legal efforts against the determination of LSD in the conversion of non-agricultural land functions as an unlawful act.
