Abstract
This study examines the legal protection available to CV Pahala Kencana as a result of a breach of contract committed by PT XY in a work order agreement. The background of this research is based on the importance of legal certainty in the implementation of cooperation agreements between business entities. In practice, contracts often encounter obstacles in the form of breach of contract, namely the failure to fulfill agreed obligations. Such failure causes losses to the aggrieved party, in this case CV Pahala Kencana, both materially and immaterially. The purpose of this study is to analyze the forms of legal protection that may be obtained by CV Pahala Kencana due to PT XY’s breach of contract, as well as the legal remedies available under statutory regulations. This research employs a normative juridical method with legislative and conceptual approaches, supported by primary, secondary, and tertiary legal materials. The findings reveal that PT XY’s breach constitutes a contractual violation, granting CV Pahala Kencana the right to claim compensation, terminate the agreement, or demand contract fulfillment in accordance with the provisions of the Indonesian Civil Code. Legal protection may take the form of litigation through the court system or non-litigation measures such as mediation or negotiation. This study emphasizes the importance of caution in drafting contracts to ensure better legal certainty and to safeguard parties suffering losses as a result of contractual violations.
