Abstract

A trademark is a sign used to distinguish goods or services from one business actor to another. Vans is a brand that has many fans in Indonesia, so Vans registered its trademark with the Directorate General of Intellectual Property. This registration does not necessarily prevent Vans from trademark disputes. The potential for trademark infringement occurs because Ventela trades merchandise that contains similarities in principle or in whole with the Vans brand. This study aims to explain the rights of the Vans trademark and the legal regulations related to the similarities between the Vans and Ventela brands. In addition, this study also aims to explain the legal efforts that Vans can take to defend its trademark rights. This study uses a normative method using a statutory approach as well as views and doctrines that have developed in legal science. The results of the study, Law Number 20 of 2016 concerning Trademarks and Geographical Indications (Law No. 20/2016 MIG) provides legal certainty regarding the legal protection of the Vans brand, registered brands have exclusive rights granted by the state. Based on these rights, the brand owner can file a lawsuit as stipulated in Articles 93 and 100 of Law No. 20/2016 on Trademarks. Therefore, Vans can defend its brand rights.
