Abstract

The transportation of goods by land between PT. P as the carrier and PT. S as the freight forwarder is regulated in a reciprocal agreement, which still has the potential to cause default. This study discusses the legal consequences of default when PT. P provides compensation directly to consumers, not through PT. S as agreed. The objective is to analyze the legal consequences and form of PT. P's liability to PT. S based on the Civil Code using a normative juridical method through a legislative and conceptual approach. The results of the study show that PT. S has the right to unilaterally cancel the agreement and claim compensation, while PT. P is liable in the form of reimbursement of costs, losses, and interest in accordance with Article 1243 of the Civil Code.
