Abstract

Law Number 6 of 2023 concerning Job Creation (UUCK) significantly changes the environmental legal landscape in Indonesia by repealing Article 102 of Law Number 32 of 2009 concerning Environmental Protection and Management (UUPPLH). This policy decriminalizes the crime of managing Hazardous and Toxic (B3) waste without a permit, which was previously punishable by imprisonment and fines. This study examines the legal implications and analyzes the policy from a penological perspective. The study finds that based on the principle of lex posteriori derogate legi priori, the UUCK's repeal of Article 102 of the UUPPLH is formally valid, but has serious consequences. The main implications are the loss of an effective formal offense for early mitigation, a weakened deterrent effect, and the creation of a legal vacuum that makes it difficult to take action against illegal B3 waste managers who are not waste producers. From a criminal theory perspective, this decriminalization policy contradicts the fundamental objectives of criminal law. From the perspective of the theory of retribution, administrative sanctions that replace criminal sanctions are considered disproportionate to the harm caused and fail to convey the message of moral reprehension. From a goal-based perspective, this policy significantly reduces both general and specific mitigation functions. Meanwhile, from a combined theory and integrated justification of criminal punishment, this decriminalization demonstrates an imbalance that sidelines justice and environmental protection for the sake of economic pragmatism. This study concludes that decriminalization is a step backward for environmental law enforcement in Indonesia.
