Abstract

The decision of the Supervisory Judge in accommodating the claims of creditors who registered late is the issue analyzed in this study, as it has the potential to undermine the rights of creditors acting in good faith. This is examined through a case study of Decision No. 63/Pdt.Sus/GLL/2023/PN Niaga SBY Jo. No. 40/Pdt.Sus-PKPU/2023/PN Niaga SBY. This normative legal research employs statutory, case, and conceptual approaches. The analysis shows that the Supervisory Judge’s decision is inconsistent with the principles of good faith, legal certainty, and justice. Such an action disregards the principles of paritas creditorium and pari passu pro rata parte, and may potentially harm concurrent creditors who registered their claims on time. The late submission of claims—even by separatist creditors who hold preferential rights in bankruptcy—can delay the settlement process of bankruptcy assets and lead to injustice. This study concludes that compliance with the deadline for claim registration is crucial to ensuring the integrity of the bankruptcy process and fairly protecting the rights of all creditors.
