Abstract
In Article 31 paragraph (1) UNCAC 2003, there is one confiscation system, namely value-based asset confiscation (value-based system), namely confiscation of assets or assets whose value is equivalent to the benefits obtained through corruption. This paper focuses on knowing how the implementation mechanism and implementation of the value-based asset confiscation system against assets of corruption crimes, as well as providing an overview of the obstacles and efforts faced by Malang City District Attorney prosecutors in the implementation of this value-based confiscation. This legal issue will be studied using the Juridical-Empirical research method through direct interviews in the field, review of laws and regulations, and also literature studies. The results of the research obtained are the mechanism for implementing a value-based asset confiscation system at the Malang City District Prosecutor's Office starting from the issuance of an Investigation Order, calculating state financial losses by BPK / BPKP, examining witnesses, experts, and suspects, then tracking assets and blocking assets found, applying for a confiscation permit to the head of the District Court, and ending with confiscation actions. Then the obstacles faced by prosecutors in the implementation of a value-based asset confiscation system include not finding any valuable assets belonging to the suspect, handling the case for a long time because the calculation of state financial losses by BPKP takes a long time, the perpetrator's legal counsel filed a pretrial application related to confiscation, and the installation of confiscation signs was chaotic. However, overall the implementation of this value-based asset confiscation system can be successful and optimal in recovering state financial losses.
