Abstract

This research discusses how the implementation of mediation efforts carried out by state prosecutors in the settlement of arrears in the payment of BPJS Employment dues carried out by business entities at the Gresik state prosecutor's office and also what are the obstacles and solutions to the problem. The legal basis used in the settlement of non-litigation cases is using Law No. 11 of 2021 on the amendment of Law No. 16 of 2004 concerning prosecutors in Article 30 paragraph 2 in the civil sector and TUN that the prosecutor's office can resolve outside the court on behalf of the state and the government. which is commonly called JPN which in this case BPJS Ketenagakerjaan gresik branch asks the state attorney to settle the arrears that have been carried out by 10 business entities by going through the non-litigation path. This research uses empirical legal methods, which are descriptive analysis, with data collection methods by observation, interview, questionnaire, and literature review, to be used as material in this research. The result of the implementation of the settlement of civil cases with mediation has 3 stages, namely coordination by inviting the parties, then if the implementation of the mediation is successful, it is continued by signing a peace deed, and the last stage of implementing the contents of the agreement. As for the obstacles and solutions to this problem, there are still many business entities that are only represented by representatives of the company, not directly from their officials, and also an average of these 10 business entities cannot immediately pay the amount of arrears and fines by paying off in full, in this case JPN can provide a way out by paying in installments. The conclusion that in this case the state attorney's implementation is in accordance with the existing regulations and also successful in the resolving civil cases through non-litigation or mediation
