Abstract

Indonesia is still not free from the serious threat of sexual violence which is increasing over time, influenced by technological developments. One case of electronic-based sexual violence is deepfake porn. Deepfake porn is artificial sexual content that never actually existed or occurred by stealing visual data about the victim's body in audio-visual form, then manipulating photos or videos with the aim of sexualizing them without the victim's consent. The problem of deepfake porn in Indonesia is not a new problem considering that many cases have occurred in the wider community and technological developments cannot be stopped. This research applies a juridical-normative method with a statutory, case and conceptual approach with a descriptive method to describe existing legal problems. Handling deepfake porn cases requires a comprehensive approach and strong law enforcement so that perpetrators can be held accountable for their actions. Specific legal regulations regarding Artificial Intelligence (AI) technology do not yet exist in Indonesia, so currently Indonesia more often uses the Pornography Law and the ITE Law. The laws and regulations that are commonly used still have several weaknesses, so that there is no legal ambiguity, Indonesia still needs special regulations that regulate AI related activities.
