Abstract

Researchers conduct writing with the aim of examining in depth how legal protection against heirs of buyers of land inheritance disputes and the application and certainty of inheritance law in it. The type of research used in this writing is normative juridical. The problem in this research is related to rice fields that have been sold and bought by sellers and buyers who have passed away and have not changed the name of the certificate of ownership, so that problems arise in the struggle for property rights between the heirs of the buyer and the seller. This research uses legal sources, namely primary and secondary legal materials. Researchers analysed legal materials in writing using qualitative and descriptive methods, the research also used the case approach of Decision Number 80/Pdt.G/2022/PN Sda. The findings of the research indicate that legal protection for buyers has been sought, recognition of the validity of the deed of sale and purchase, as well as the need for conformity to inheritance law. This concludes that it is necessary to pay attention to the rights of each heir as well as the importance of providing fair legal protection for buyers and their heirs, so that it will not cause disputes in the future.
