Abstract

Land acquisition for public interest is often important for development, but it often also causes problems, especially in terms of providing inappropriate compensation to landowners. This study aims to understand the legal impact of such inconsistencies and how legal protection for landowners is regulated in Law Number 2 of 2012. This study was conducted using a normative legal approach, using data from literature studies and analyzing relevant legislation and court decisions. The results of the study indicate that that discrepancies in compensation viii can result in economic losses and legal issues for landowners. However, Law No. 2 of 2012 establishes a transparent and fair mechanism for determining compensation, covering land value, buildings, plants, and both physical and non physical losses. This process ensures fairness and transparency in compensation. Discrepancies in assessment can lead to disputes, but landowners have the right to file objections through preventive and repressive legal mechanisms via the court. The study highlights the importance of transparency and fairness in land acquisition processes to meet public interests without neglecting landowners' rights.
