Abstract
The ratio decidendi in the Surabaya District Court Decision Number 1393/Pdt.G/2022/PN.Sby pertains to a debt agreement with shares as collateral. The main focus of this research is to understand the legal basis applied by the judge in deciding the case. The objective of this research is to analyze how legal provisions were applied by the judge in resolving the dispute regarding the debt agreement with shares as collateral and to assess the implications of the decision on the protection of creditor and debtor rights. The research method employed is normative juridical with a case approach. The data used includes primary data in the form of court decisions and secondary data consisting of relevant legal literature. The conclusion of the research indicates that the judge in the decision emphasized the validity of the agreement, compliance with obligations, and the protection of creditor rights. The judge's ratio decidendi highlights the importance of the principles of justice and legal certainty in resolving disputes over debt agreements with shares as collateral.
