Abstract

The United States of America was the first country to discover crypto transactions on the child pornography site called Welcome to Video, which led to the arrest of Son Jong Woo at his residence, a South Korean national as the administrator of the Welcome to Video site. The United States of America then submitted an extradition request to South Korea for Son Jong Woo but it was rejected by South Korea. In this thesis the author intends to understand the urgency of the United States submitting an extradition request to South Korea and how South Korea’s decision to reject the extradition request reviewed based on the extradition treaty in force between the United States of America and South Korea. This thesis uses a statutory approach, case approach, and conceptual approach within the scope of normative legal research method. The results of this study are the urgency of the United States submitting an extradition request to South Korea based on the authority of the United States in prosecuting Son Jong Woo and South Korea’s decision to reject the United States extradition request cannot be qualified as a violation of the extradition treaty in force between the United States and South Korea.
