Abstract

The use of drugs in the process of curing disease must pay attention to the type of drug and the correct dosage, apart from that the drug must also be a drug that has a distribution permit so that the quality, efficacy, quality and safety in its use are guaranteed. In human medicines, quality and quality testing of medicines and the issuance of distribution permits is carried out by BPOM, which is then sold in pharmacies, while in veterinary medicines, testing of the quality and quality of animal medicines is carried out by BBPMSOH and the distribution permit is issued by the Indonesian Ministry of Agriculture, which is then sold in markets. veterinary drug stores, poultry shops, and pet shops. The distribution permit for veterinary medicines is marked with a registration number from the Indonesian Ministry of Agriculture. Veterinary medicines that do not have a distribution permit are not tested for the quality and quality of the medicine, so that the use of the medicine on animals can endanger the health of the animal that consumes it. The legal distribution of animal medicines is regulated in Law No. 18 of 2009 in conjunction with Law No. 41 of 2014 concerning Animal Husbandry and Animal Health. If a pet shop sells animal medicine without a distribution permit, it does not rule out the possibility for animal owners to buy the medicine and give it to pets, which could cause losses for the animal owner. This is the focus of research which will examine PMH for the sale of animal medicines without distribution permits carried out by pet shops based on Article 1365 of the Civil Code which states that a PMH must fulfill several elements, namely the existence of an unlawful act, error, loss, and a causal relationship between the loss and the act..The research was conducted using normative juridical methods with an approach to facts, cases and statutory regulations. Animal owners who suffer losses due to the sale of animal medicines without distribution permits by pet shops can submit legal remedies for litigation or non-litigation. Regulated in Article 1365 of the Civil Code, pet shops as perpetrators of PMH are obliged to provide compensation to owners of injured animals.
