Abstract

This study aims to determine the permissibility of royalties on musical artworks as an object of joint property. Starting from the divorce case of a musician with his wife, where in the divorce lawsuit the wife demanded royalties on musical artworks that had been produced during marriage by her husband to be used as a legal object in a joint property lawsuit. This research reviews how royalties specifically when viewed from the perspective of the Property Law of the Civil Code and the Property Law of the Compilation of Islamic Law. The methodology used is normative juridical analysis by linking related regulations. The analysis is carried out by looking at legislation and previous research by looking at the material properties of royalties if they are used as joint property. The urgency of this research is to see the fact that the legal umbrella related to the distribution and transfer of royalties on musical artworks still cannot answer the increasingly dynamic needs of society so that legal reform is needed. The results of this study provide a view that from the perspective of property law, royalties can be used as an object of joint property by looking at the nature of royalties on musical artworks which are an economic form and have benefits while still paying attention to the rights inherent in the musical artwork.
