Abstract

In implementing waqf, the Waqf Pledge Deed has a very important meaning because after the Waqf Pledge Deed is made, the waqf will be proven to be true and the deed can protect and guarantee the continued existence of the waqf. In fact, there are still several waqf implementations that only fulfill the pillars and requirements of Islamic law without making a Waqf Pledge Deed, as happened in Tempeh District, Lumajang Regency. The method used is a normative research method. Secondary data was obtained through books, articles, the internet, and scientific essays with legal material obtained from several regulations that are still related to the object to be researched, interviews, and legal dictionaries. The legal position of waqf land that is given verbally as an object in a sale and purchase agreement is valid according to positive law because it fulfills the terms of sale and purchase, so that the sale and purchase agreement is not void.
