Abstract
This research aims to conduct an in-depth investigation into the practice of law enforcement against child trafficking offenders within the East Java Regional Police area, while also inventorying a number of challenges faced and the stages taken to resolve them. The scope of the study focuses on the cycle of the justice system, from the pre-investigation level to the investigation level, aspects that intervene in the productivity of case management, as well as the format of legal defense accommodated for children as victims. Furthermore, this research also tests the extent of alignment between the operationalization of the law in the field and the applicable positive legal dictum. Empirical juridical is a system based on a qualitative approach, with data obtained through personal interviews with law enforcement officers within the East Java Regional Police area, document research, and evaluation of primary and secondary legal materials related to child trafficking cases. The results of the study indicate that the realization of legal handling has basically been carried out according to established standards, which consist of the stages of evidence search, investigation, and case forwarding. However, in practice, several obstacles remain, including limited human resources, difficulties in gathering evidence, low victim and witness participation, and the influence of social and economic factors that contribute to child trafficking. Furthermore, the increasingly complex modus operandi of perpetrators also poses a challenge for law enforcement officers in carrying out their duties.
