Abstract

ABSTRACT: The practice of unregistered (siri) marriage in Gresik City remains prevalent, creating legal uncertainty regarding the civil rights of children born from such unions. This study is urgent as it addresses the vulnerability of children in accessing essential rights, including legal identity, inheritance, and maintenance, which are often neglected due to administrative barriers. The research employs an empirical legal method with a descriptive-analytical approach, collecting data through interviews and observations. The results indicate that, while Constitutional Court Decision No. 46/PUU-VIII/2010 provides a legal avenue for the recognition of children born from unregistered marriages, its implementation in Gresik faces bureaucratic and social obstacles. Furthermore, parental obligations following an unregistered divorce often lead to child neglect and custody disputes. It is concluded that legal protection requires strengthening through the isbat nikah mechanism and more responsive local administrative policies to ensure that the best interests of the child are prioritized over the legal status of the parents.
