Abstract
Corruption crimes cause state financial losses, necessitating recovery efforts through the imposition of additional penalties in the form of compensation. This study aims to analyze the effectiveness of compensation for corruption crimes on state financial recovery by the Public Prosecutor at the Kediri City District Attorney's Office and the factors that influence it. This study uses an empirical legal method with a statutory and sociological approach. Data were obtained through interviews and literature studies, then analyzed descriptively qualitatively. The problem in this study is related to Law Number 31 of 1999 Article 18, which in practice has not been appropriate. The results of the study indicate that the application of compensation is carried out through identifying state financial losses, determining the amount of compensation based on the flow of funds enjoyed by the defendant, compiling criminal charges, and execution through confiscation and auctioning of the convict's assets. The application of compensation has contributed to state financial recovery and is quite effective because some of the state losses were successfully recovered through the payment of compensation and asset execution. This effectiveness is influenced by legal factors, law enforcement factors, facility factors, and community factors. Obstacles encountered include difficulties in tracking assets, lengthy auction processes, resistance from third parties to execution seizures, and the existence of subsidiary prison sentences that convicts often choose rather than paying compensation.
