Abstract

The purpose of this study is to determine and analyze the implementation of institutional guidance for Children in Conflict with the Law at UPT PRSMP Surabaya, as well as to identify the obstacles and efforts in the implementation of such guidance. The background of this research is the importance of implementing a juvenile criminal justice system that prioritizes restorative justice and social rehabilitation approaches in accordance with the Juvenile Criminal Justice System Law and Regulation of the Minister of Social Affairs of the Republic of Indonesia No. 26 of 2018. The research method used in this empirical legal study applies a structural approach and an interdisciplinary approach. Data sources were obtained through interviews, observations, literature studies, and documentation, which were then analyzed qualitatively and descriptively. The research was conducted at UPT PRSMP Surabaya, a social institution responsible for providing care and guidance for ABH under the authority of the Social Service of East Java Province. The results of the study indicate that the guidance process for ABH at UPT PRSMP Surabaya has been implemented in accordance with applicable legal provisions; however, its implementation has not been fully effective. Several challenges require attention, including limited human resources, inadequate facilities and infrastructure, and obstacles related to family support in the social reintegration process, which affect the effectiveness of the guidance program. The efforts undertaken by UPT PRSMP Surabaya include strengthening human resource capacity, optimizing facilities and infrastructure, and enhancing the role of families in supporting the guidance process and social reintegration of ABH.
