Abstract

Sentencing disparity in electronic gambling promotion cases raises a legal issue over the consistency of judicial ratio decidendi. This article limits its analysis to judicial considerations in Decision Number 123/Pid.Sus/2023/PN.Pyh and Decision Number 156/Pid.Sus/2025/PN.Sgn, and to the elements of distributing electronic information containing gambling content. This research uses normative legal method with statutory, case, and conceptual approaches. The first issue examined concerns the analysis of judicial considerations in adjudicating perpetrators of the criminal act of distributing electronic information containing gambling content in the two decisions. The second issue elaborates the constituent elements of perpetrators involved in the criminal act of distributing electronic information containing gambling content in the two decisions. The Sragen Decision is more explicit than the Payakumbuh Decision, however the sentencing disparity between the two decisions is significantly different.
