Abstract

This study employs a normative legal research method with statutory and conceptual approaches. The primary legal sources include the Indonesian Civil Code, Law Number 35 of 2014 concerning the Amendment to Law Number 23 of 2002 on Child Protection, and Government Regulation Number 17 of 2025 concerning the Governance of Electronic System Providers in Child Protection (PP TUNAS). The findings indicate that the validity of a child as an influencer in receiving endorsements depends on the fulfillment of the legal requirements of an agreement, particularly with regard to legal capacity as regulated in Article 1320 of the Indonesian Civil Code. Therefore, a child who has not yet attained legal capacity must be represented by a parent or guardian in engaging in legal relations with business actors. Legal protection for children as influencers should be implemented through both preventive and repressive measures by upholding the principle of the best interests of the child, including parental supervision, age verification, parental consent in endorsement collaborations, as well as dispute resolution mechanisms and the imposition of sanctions in the event of violations of the child’s rights.
