Abstract

This study aims to determine the legal protection and legal certainty provided by PT Shopee International Indonesia to ShopeeFood drivers in dealing with the issue of fictitious orders on the ShopeeFood service. The background of this research is taken from the increasing problem of fictitious orders, resulting in real losses for ShopeeFood drivers. This study uses an empirical juridical research method by applying a legislative approach, a conceptual approach, and a case study approach. The legal material is sourced from primary legal materials, secondary legal materials, and non-legal materials. Data collection methods were carried out through field studies and literature studies. The results of this study indicate that PT Shopee International Indonesia provides legal protection to ShopeeFood drivers, both preventively and repressively. However, in practice, it is still ineffective in providing legal protection and certainty for ShopeeFood drivers.
