Abstract

This study examines the authority of the Manpower and Transmigration Office (Disnakertrans) of East Java Province in assisting the Governor in the process of determining the District/City Minimum Wage (UMK) for 2025, which led to a lawsuit filed by the FSP KAHUTINDO Workers' Union against the Governor of East Java's Decree Number 100.3.3.1/775/KPTS/013/2024. The Governor set a 5% UMK increase, deviating from the 6.5% formula stipulated under Ministerial Regulation Number 16 of 2024, prompting the Surabaya Administrative Court (PTUN) through Decision Number 11/G/2025/PTUN.SBY to grant the lawsuit and order the revocation of the decree. This study employs an empirical legal method with a descriptive-analytical approach, conducted through interviews with Disnakertrans officials, analysis of court decisions, and review of applicable legislation, in order to examine the gap between legal norms (das sollen) and their implementation in practice (das sein).The findings reveal two key conclusions. First, Disnakertrans's authority derives from Law No. 6 of 2023 in conjunction with Government Regulation No. 51 of 2023, encompassing tasks such as conducting Decent Living Needs surveys, verifying BPS statistical data, coordinating input from 38 districts/cities, and preparing technical recommendations for the Governor. Although formal procedures were followed, the Administrative Court found that the Governor's Decree violated the General Principles of Good Governance (AUPB) particularly the principles of legal certainty, transparency, and proportionality as the deviation from the mandatory formula lacked adequate justification and documentation. Second, Disnakertrans faced several obstacles, including regulatory ambiguity in Article 27 paragraph (2) of PP 51/2023 which provides no clear indicators for formula deviation, limited human resources, and insufficient capacity to handle administrative court proceedings. In response, Disnakertrans developed new standard operating procedures, strengthened inter-agency coordination, and proposed regulatory revisions. This study concludes that weaknesses in applying the AUPB principles particularly regarding transparency and legal certainty were the primary cause of the Governor's Decree being annulled. It is recommended that PP No. 51 of 2023 be revised to clarify the criteria for formula deviation, and that Disnakertrans establish a transparent, data-driven, and sustainable UMK determination framework going forward.
