Abstract
This study examines the legal position of a possessor (bezitter) in acquiring ownership rights over land based on Article 529 of the Indonesian Civil Code, as well as the limits of legal protection that can be granted to parties controlling an object. The issues addressed arise from the fact that control over an object does not always indicate ownership rights, thus requiring an analysis of the extent to which the elements of corpus, animus, and good faith can serve as the basis for legal recognition of a possessor. This research also analyzes the relationship between physical control over land, acquisitive prescription, and proof of ownership in Indonesian civil law, particularly regarding land that is physically controlled for a certain period of time. The research employs a normative method with statutory and conceptual approaches. The findings indicate that a possessor may obtain legal protection as long as the control is exercised physically, continuously, accompanied by the intention to possess as one’s own, and carried out in good faith. However, such control does not automatically result in ownership rights, as recognition and transfer of rights must still comply with the legal requirements stipulated in statutory regulations. The legal position of a possessor in Indonesian civil law is therefore limited and cannot be fully equated with that of a lawful owner. Nevertheless, under certain conditions, a possessor may strengthen their legal position if good faith can be convincingly proven before the law.
