Abstract

Law enforcement against illegal access crimes by phishing mode through electronic links still faces various obstacles in terms of mechanisms, technical, human resources, inter-agency coordination, and the community. The limitations of the Criminal Procedure Code in accommodating electronic evidence and the lack of integration of operational guidelines in the Electronic Information and Transaction Law and the Personal Data Protection Law are obstacles in the investigation process. This research is an empirical legal research with a legislative approach and a conceptual approach that is descriptive and analytical. The research was conducted through a case study at the Directorate of Cyber Investigation of the East Java Regional Police. Data were obtained through interviews, observations, and literature studies, then analyzed using Lawrence M. Friedman's legal system theory and the integrated criminal justice system (ICJS) approach. The results of the study show that investigators have made adaptive efforts through the use of digital forensic technology to ensure the validity of electronic evidence. However, there are still obstacles in the investigation mechanism, limited facilities and infrastructure, and the lack of integrated operational technical guidelines. Therefore, it is necessary to prepare comprehensive technical guidelines, improve the competence of investigators, and strengthen coordination between agencies based on the integrated criminal justice system to increase the effectiveness of investigations and legal certainty in handling illegal access crimes.
