Abstract

The development of Artificial Intelligence (AI) technology in the transportation sector has given rise to the innovation of semi-autonomus cars, which operate through a shared control system between humans and machines. The presence of semi-autonomous cars creates a legal vacuum in determining the criminal liability of drivers, given that the National Penal Code and the Traffic and Road Transport Law still adhere to a conventional paradigm that assumes the driver holds full control over the vehicle. This study aims to analyze the regulation and application of the culpability concept within Indonesia’s criminal liability system and to examine the forms of criminal liability applicable to semi-autonomous car drivers who cause traffic accidents. The research employs a prescriptive normative juridical method using statute, conceptual, and comparative approaches. The findings indicate that the culpability concept under the National Penal Code and theTraffic and Road Transport Law hast not yet accommodated shared control scenarios berween humans and automated systems, thereby creating legal uncertainty in assessing the negligence of semi-autonomous cars drivers. It is concluded that normative reconstruction is necessary, including revision of the Traffic and Road Transport Law and the establishment of specific regulations governing semi-autonomous vehicles that incorporate adaptive culpability standards in line with technological advancements.
