Abstract
This study analyzes the legal status of oral land lease agreements and the forms of civil liability of the aggrieved party. The author uses a normative juridical method through a statutory and conceptual approach. Based on the results of this study, it is known that whether an oral agreement is binding depends solely on whether the elements of a valid agreement as stipulated in Article 1320 of the Civil Code are fulfilled. Normatively, the legal status of a land lease agreement made solely based on discussions contained in Article 1571 of the Civil Code is valid and equal to an agreement set out in written form, but often places the injured party as the party entitled to receive their violated rights into a weaker party. Weak proof due to the absence of physical evidence and a lack of understanding of the law, become obstacles for the aggrieved party to request civil liability for compensation. Alternative dispute resolution is an appropriate step as an initial legal effort to resolve the problem. Thus, in the example of a problematic case of civil liability such as this study, it is recommended that the public increase awareness of the risks of violations and the need to emphasize the obligation to use written agreements as an effort to prevent losses from an agreement.
