Abstract

Legal protection is an act of state institutions in defending or maintaining certain individuals and entities regarding legal disputes experienced under the law. The purpose of this case study, discusses the loss of labor rights, especially salaries and benefits in connection with Putusan Nomor 78/Pdt.Sus - PKPU/2021/PN Niaga Surabaya. Research methods in the form of Juridical Normative around the implementation of the rules or principles contained in the Labor Law, Bankruptcy and PKPU Law, and Wage Law. How to process materials using scientific literature related to financial distress and interviews of supervisory judges. Research analysis leads to delays PT. X Perkapalan Surabaya to meet the deadline for The Peace Plan proposal agreement. In addition, it was found that the results of the Lex Superior Derogate Legi Inferiori on the position of workers as creditors to the status of Debt Payment Obligation Delay (PKPU). Unconstitutional norms occur due to conflict with the decision of Constitutional Court Number 67/PUU-XI/2013, so it is obliged to revise the law as a binding constitutional interpretation.
