Abstract

The development of digital technology has transformed marketing practices through social media, including promotional cooperation agreements (endorsements) on the TikTok application. This study analyzes the legal protection for Endorsers against defaults committed by Endorsees in endorsement agreements. The main problem is the legal relationship between the parties and the legal protection available in the event of default, particularly late payment of honorarium. This study uses a normative juridical method with a regulatory and conceptualization approach. Data sources include primary legal materials (Civil Code, ITE Law, Trade Law, Consumer Protection Law), secondary legal materials (journals, books, previous research), and tertiary legal materials (legal dictionaries, interviews). Data analysis was conducted descriptively and prescriptively. The results of the study indicate that the legal relationship between Endorsee and Endorser is contractual. The Endorsee is positioned as an employer who is obliged to pay honorarium, while the Endorser is the recipient of work who is responsible for promotional content. Legal protection for endorsers against breach of contract is provided through the Civil Code in the form of compensation, contract cancellation, or a summons, with a compensatory nature aimed at restoring the rights of the injured party.
