Abstract

E-commerce transactions using the Cash on Delivery (COD) payment system through the Shopee application are a widely used payment method in Indonesia, but often pose risks for business actors. Unilateral payment cancellations by consumers cause losses for business actors. This study analyzes legal protection for business actors against the risks and losses from payment cancellations made by consumers without valid reasons based on laws and regulations, the Civil Code, and Shopee's terms and conditions. This study uses a normative juridical method that is descriptive prescriptive. The results of the study indicate that consumer actions to cancel payments without valid reasons are considered an act of default and business actors can take preventive and repressive legal protection efforts, both by increasing caution in transactions and through civil legal efforts by demanding compensation based on Article 1243 of the Civil Code.
