Abstract
ABSTRAK: Perkembangan transaksi elektronik melalui platform e-commerce seperti Shopee memunculkan permasalahan hukum antara pelaku usaha dan konsumen yaitu adanya pengajuan pengembalian dana tanpa pengembalian barang dengan bukti yang tidak memadai yang menyebabkan kerugian pada pelaku usaha. Kebijakan platform Shopee terkait proses pengembalian dana tanpa barang yang sering disalahgunakan konsumen masih terdapat ketidakseimbangan antara konsumen dan pelaku usaha akibat mekanisme verifikasi bukti yang lemah serta waktu tanggapan yang terbatas bagi pelaku usaha. Penelitian ini bertujuan untuk menganalisis upaya hukum dan perlindungan hukum bagi pelaku usaha atas ajuan pengembalian dana tanpa barang yang merugikan di Shopee. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif. Hasil penelitian perlunya reformasi sistem penyelesaian sengketa di e-commerce agar dapat memberikan jaminan keadilan seimbang dan perlindungan hukum yang memadai bagi pelaku usaha dalam menghadapi potensi penyalahgunaan hak oleh konsumen serta perlindungan hukum menunjukkan masih ada ketidakadilan dalam penyelesaian sengketa di platform, terutama karena kurangnya transparansi, akses waktu memadai, dan objektivitas dalam pengambilan keputusan oleh Shopee. Kata Kunci: Perlindungan Hukum, Pelaku Usaha, Perbuatan Melawan Hukum, Pengembalian Dana Tanpa Barang, Shopee ABSTRACT of electronic transactions through e-commerce platforms such as Shopee has given rise to legal issues between businesses and consumers, namely the submission of refund requests without returning the goods and with insufficient evidence, causing losses to businesses. Shopee's policy regarding refunds without goods, which is often abused by consumers, still creates an imbalance between consumers and businesses due to weak evidence verification mechanisms and limited response time for businesses. This study aims to analyze legal efforts and legal protection for businesses against harmful refund requests without goods on Shopee. The research method used in this study is normative juridical. The results of the study indicate the need for reform of the dispute resolution system in e-commerce in order to provide balanced justice and adequate legal protection for business actors in facing potential abuse of rights by consumers. The study also shows that there is still injustice in dispute resolution on the platform, mainly due to a lack of transparency, adequate access time, and objectivity in decision-making by Shopee.
