Abstract

This study discusses legal protection efforts against unlawful acts in the form of building demolition from a civil law perspective. This issue is a serious matter for discussion because the unlawful acts committed involve the demolition of disputed objects that exceed the authority of the court based on Law Number 48 of 2009 concerning Judicial Authority. Based on this violation, it is necessary to address the legal issue by adopting a conceptual approach to determine the legal measures that can be taken by the materially aggrieved party. This study uses a normative legal method combined with a statutory approach as a reference for analysis in terms of legislation and a conceptual approach as an analysis to determine the legal measures that can be taken in resolving this case. The results of the study indicate that in classifying the criteria for unlawful acts to determine the compensation that should be provided, it is necessary to consider the causal relationship between the act and the resulting loss. The implementation of legal protection will be faster and more efficient if the parties use legal remedies outside of court, namely alternative dispute resolution (APS).
