Abstract

The phenomenon of overclaim in skincare products in Indonesia has become increasingly concerning alongside the rapid growth of the beauty industry, where business actors make claims regarding product composition or benefits that are inconsistent with reality, thereby creating potential harm to consumers. This study aims to analyze the legal protection available to aggrieved consumers and the dispute resolution mechanisms that can be pursued. Employing a normative juridical method through the examination of statutory regulations, case studies, and a conceptual approach, the findings reveal that both preventive and repressive legal protections are stipulated under the Consumer Protection Act and BPOM regulations. However, implementation remains hindered, particularly in terms of supervision and enforcement of sanctions, thus necessitating regulatory reinforcement and the optimization of both litigation and non-litigation dispute resolution mechanisms.
