Abstract

This study discusses the fulfillment of the right to education in the era of regional autonomy in East Java Province, especially in the context of implementing mandatory spending by local governments. Using normative legal research methods, this study examines the regulation and implementation of education policies as a form of state responsibility for citizens' constitutional rights. Research results show that although the allocation of education budget in East Java has met a minimum limit of 20% according to the mandate of the 1945 Constitution, the equalization of access and quality of education has not been fully achieved. Inequalities are still found mainly in archipelago areas such as Bangkalan and Sumenep. The free education program launched by the government is not optimal in reaching people in remote areas. Therefore, a strategy to strengthen regional education governance, equalize facilities and infrastructure, and distribute teachers proportionally is needed. This study recommends data-based policies and budget transparency as an effort to ensure the right to education evenly throughout East Java in the era of decentralization.
