Abstract
Copyright is a form of legal protection for creative works, including songs and music, which gives creators exclusive rights to control the use and profit from their creations. However, in practice, there are still many violations of this right, especially in commercial activities such as music concerts, where the use of songs is not accompanied by royalty payments to the creators. This study aims to examine the provisions for royalty payments in commercial activities according to Government Regulation Number 56 of 202 concerning the Management of Song and/or Music Copyright Royalties and the forms of legal protection available to creators. The research method used in this study is normative juridical with a statutory and conceptual approach. Data were obtained through a literature study of statutory regulations, legal books, and previous studies. The results of this study indicate that royalty payments are a legal obligation for every user of songs in commercial activities, and creators are entitled to compensation through the Collective Management Institute (LMK) and the National Collective Management Institute (LMKN). The case of Agnez Monica's music concert is a concrete example of how these provisions are still often ignored, thus, this will result in losses for creators such as Ari Bias. Legal provisions regarding royalties have been detailed, but their implementation remains challenging due to weak legal understanding, oversight, and compliance among industry players. Therefore, strengthening law enforcement and optimizing the role of LMK and LMKN is necessary to ensure creators' rights are protected fairly and effectively.
