Abstract

Credit problems often arise when banks carry out one of their main activities, namely providing credit. Credit problems arise when debtors do not pay off the credit given by the bank in accordance with the credit agreement which includes interest and principal. One of the banks that has problematic credit is PT. Bank Pembangunan Daerah Jawa Barat dan Banten, Tbk Surabaya Branch as one of the BUMD banks that has problems, namely the emergence of credit problems. Where the credit problems arise has a direct impact on the liquidity and stability of the bank. Therefore, PT. Bank Pembangunan Daerah Jawa Barat dan Banten, Tbk Surabaya Branch provides a fast, precise, and accurate solution, namely by submitting a request for non-litigation legal assistance to the State Attorney at the Surabaya District Attorney's Office. The purpose of this study is to carry out the provision of legal assistance, as well as obstacles and efforts in the process of providing legal assistance as an effort to resolve problematic credit by the Surabaya District Attorney's Office. The research method used is empirical with a structural approach (structural approach). The results of this study indicate that the role of the State Attorney at the Surabaya District Attorney's Office in providing non-litigation legal assistance as an effort to resolve problematic credit has been carried out in accordance with the Prosecutor's Regulation Number 7 of 2021 concerning Guidelines for the Implementation of Law Enforcement, Legal Aid, Legal Considerations, Other Legal Actions, and legal services in the Civil and State Administration Fields. And there are obstacles faced by the State Attorney at the Surabaya District Attorney's Office which arise from external and internal factors in the process of implementing the provision of legal assistance as an effort to resolve problematic credit.
