Abstract

This research discusses the legal protection of emergency contact owners who are unilaterally included in the Shopee Pinjam service from a civil law perspective. This phenomenon raises legal issues related to violations of privacy rights and potential misuse of personal data. The purpose of this research is to analyze the legal protection and civil liability of Shopee Pinjam borrowers against losses suffered by emergency contact owners due to unilateral data inclusion. This research uses a normative juridical method with a legislative approach, relevant civil law concepts, and case studies related to unlawful acts as regulated in the Civil Code Article 1365. The results show that the unilateral inclusion of emergency contacts is a violation of privacy rights categorized as unlawful acts and has implications for civil liability. However, until now there has been no regulation that explicitly regulates legal protection for emergency contact owners, so that the litigation and non-litigation settlement mechanisms in this case are used as concepts in determining the legal liability of the borrower or debtor. Therefore, it is necessary to strengthen personal data protection regulations and policies to prevent the misuse of emergency contacts in online lending services.
