Abstract

The free return warranty service for reasons of changing your mind is a feature of returning goods in their original state provided by the marketplace to support buying and selling transactions. However, this feature can have a negative impact on business actors who are marketplace partners, because consumers can return goods easily even though the goods do not meet the criteria for returnable goods. Thus, the problem raised in this thesis is when consumers return goods through the return service for reasons of changing their minds, but the goods returned to the business actors have been used, causing losses. For these actions, consumers have violated the rights of business actors and are not in good faith towards the return of goods that take place in buying and selling activities through the marketplace. Therefore, legal protection is needed for business actors to protect their rights from consumer actions that are considered detrimental. The method used in this research is normative juridical research with a statutory approach and conceptual approach. The results of this study indicate that the relationship between consumers and business actors is bound in a sale and purchase agreement, which in its implementation must be based on good faith. Consumers who do not carry out their good faith optimally have violated the rights of business actors and can be held accountable. The guarantee of protection of the rights of business actors in a preventive manner has been regulated in the Consumer Protection Law. Meanwhile, repressive protection can be achieved with the appeal feature provided by the marketplace and the request for compensation by business actors to consumers. This protection aims to maintain the rights of business actors.
