Abstract
This study discusses the validity of verbal employment agreements applied to freelance workers in the catering business or known as freelance waiters. In practice, freelance waiters are employed without a written employment agreement, causing legal uncertainty regarding the rights and obligations of the parties. The study applies a normative research method with a statute approach and a conceptual approach with a literature review as a procedure for collecting legal materials. The results of the study indicate that verbal employment agreements can be considered valid if they meet the elements regulated in Article 1320 of the Civil Code and Article 52 paragraph 1 of the Manpower Law. Although all the valid requirements of an employment agreement in Article 1320 of the Civil Code and Article 52 Paragraph 1 of the Manpower Law have been met, if the content or implementation of the agreement is contrary to other legal rules, public order, or morality, then the employment agreement has no legal force and can be terminated based on the provisions of applicable laws and regulations. The failure to fulfill the rights of freelance waiters such as late payment of wages and overtime in working causes losses that require protection and legal efforts to resolve disputes between catering entrepreneurs and freelance waiters.
