Abstract

This study examines the regulations on gender reassignment in Indonesia by analyzing two court decisions: Decision Number 402/Pdt.P/2024/PN Jkt.Brt and Number 30/Pdt.P/2022/PN Pwt. The study highlights disparities in the ratio decidendi of these cases, revealing the absence of clear legal standards. A normative juridical approach is applied to analyze existing regulations (ius constitutum) and propose an ideal legal framework (ius constituendum) regarding gender reassignment issues. The findings indicate that the lack of explicit regulation forces judges to rely on subjective discretion, potentially creating legal uncertainty and injustice. Therefore, this research recommends the establishment of comprehensive regulations to provide clear guidelines and enhance judges' capacity to understand transgender and transsexual issues. With an ideal regulatory framework, the Indonesian legal system is expected to uphold justice, legal certainty, and legal utility while addressing evolving social phenomena.
