Abstract
Construction work contracts between service providers and service users must comply with the applicable laws and regulations in Indonesia. However, differences in interpretation or inconsistencies in contract drafting often lead to ambiguities regarding the rights and obligations of both parties, which can result in disputes. This study aims to analyze the resolution of breach of contract disputes in construction contracts, focusing on the villa construction project in Ubud, Bali. The main objective of this research is to assess how well the construction contract complies with the applicable regulations in Indonesia. This research employs a normative juridical method with a legislative and conceptual approach. The findings indicate that although the contract met the requirements for a valid agreement under Law No. 2 of 2017 on Construction Services, the service user breached the contract by failing to fulfill their obligations. Dispute resolution efforts through deliberation did not result in a satisfactory solution for both parties, leading the service user to terminate the contract, despite incurring material and immaterial losses. In conclusion, dispute resolution through deliberation is not always effective, and further legal steps are necessary to resolve the dispute. This research is relevant in understanding the dynamics of dispute resolution in construction contracts, particularly related to breaches by the service user.
