Abstract
Abstract. Considering considerations in a law function to provide an explanation of the philosophical, juridical and sociological elements of the norms regulated in the law. Implementing provisions of Article 24 of Law Number 20 of 2003 concerning the National Education System, it was found that the accompanying preamble does not contain a legal basis that is relevant enough or inadequate to support the implementation of the provisions in question. This research uses a normative approach by analyzing related laws and regulations focusing on the legal basis stated in the preamble, as well as related legal literature. This inconsistency has an impact on the lack of juridical aspects and legal clarity in the implementation of the article to ensure harmonization in the formation of laws and regulations in accordance with legal principles.
