Abstract

This research aims to understand the implementation of mediation in divorce cases and the effectiveness of mediation in resolving divorce cases at the Surabaya Religious Court from 2020 to 2023. The background of this study stems from the high number of divorce cases handled by the Surabaya Religious Court. This research employs a juridical-empirical method using a statute approach and conceptual approach. Legal materials are sourced from primary legal materials, secondary legal materials, and non-legal materials. The collection of legal materials was conducted through field observations, interviews, and literature studies. The results of this study indicate that the mediation process in divorce lawsuits at the Surabaya Religious Court is carried out but is not effective. The ineffectiveness of mediation in divorce lawsuits at the Surabaya Religious Court is generally caused by cultural factors and changing values in society, as well as the implications of the feminist movement. The feminist movement has created space for women to continue developing and becoming independent, which subsequently leads to issues of dual roles within the household.
