Abstract

Narcotics abuse in Indonesia is a crime that is still widespread. In 2023, in the January-June period, narcotics abuse have reached 19,401 cases. Various efforts have been made by the government to overcome the spread of narcotics. One way is through rehabilitation. Rehabilitation is care carried out by the government for the recovery and treatment of narcotics abusers so that they can recover as before consuming narcotics. Rehabilitation is treatment that is carried out without imposing criminal penalties on narcotics abusers. However, even though the rehabilitation program is carried out, there are still many recidivists who abuse narcotics. This research aims to analyze whether the implementation of existing rehabilitation is in accordance with existing standards or not based on facts in the field studied through empirical juridical research to find out how the law works in society. The results of the research found the fact that the implementation of rehabilitation at the Surabaya City BNN was in accordance with the standards and legal regulations, however the recidivism was due to internal factors originating from the clients or abusers themselves. It is hoped that in the future the government will be more aggressive in conducting outreach regarding the dangers of narcotics and the importance of rehabilitation for narcotics abusers so that it can increase public knowledge regarding the dangers of narcotics and the importance of rehabilitation for narcotics abusers.
