Abstract

Suko Sutrisno as Arema FC Stadium Security Officer was deemed guilty in the Kanjuruhan Tragedy because he was negligent in carrying out his duties and responsibilities. Suko Sutrisno was legally declared and proven to have committed negligence which caused another person's death, serious injury and injury to such an extent that it resulted in temporary illness as regulated in Article 359 and Article 360 of the Criminal Code (KUHP). This research was conducted to determine and analyze the elements of the articles used regarding the negligence of Arema FC Security Officer Suko Sutrisno in the Kanjuruhan Tragedy as well as the judge's beliefs based on the evidence contained in the judicial process. The type of research used to answer the problems in writing this thesis is normative juridical research by analyzing secondary data through literature study. The results of this research conclude that the actions taken by Suko Sutrisno have fulfilled the elements of a criminal act and the use of criminal articles for negligence committed by Suko Sutrisno, namely Article 359 of the Criminal Code, Article 360 paragraphs (1) and (2) of the Criminal Code is in accordance with the facts. facts revealed at trial.
