Abstract
Mental illness is one of the things that is quite complicated, especially in its regulation in the field of law, there must be special arrangements or treatment that is good and effective. in the field of law, there must be special arrangements or treatment that is good and effective for the perpetrators of criminal acts with mental illness in the criminalization process. for perpetrators of criminal acts who suffer from mental illness in the criminalization process to punishments and actions, based on this, a comparative study can be carried out to find out the strengths and weaknesses of the following based on this, a comparative study can be conducted to find out the advantages and disadvantages which can then be can be taken into consideration to be applied in Indonesia, in this study using the Netherlands, which has a historical background.
