Abstract
Air transportation is a transportation that is in great demand with various types of transportation convenience and relatively short travel time. However, in the implementation of air transportation there are also errors made by airlines such as flight delays and/or cancellations and loss of baggage baggage. This is certainly detrimental to passengers as service users air transportation because in the law of transportation there are 3 (three) principles: accountability, namely, the principle of accountability based on error, the principle of liability based on presumptions and the principle of absolute liability. Method The research that the author uses is normative juridical, research based on data sources in the form of applicable laws and regulations, decisions court decisions, journals or articles and legal theories and concepts and the views of leading legal scholars, with a note in order to find answers by analyzing or comparing one with the other other. The analysis is based on UUPK, PERMENHUB No. 77/2011 and PERMENHUB No 89/2015. The results of this study can be seen through the form of the airline's fault and liability for the error liability given to the airline, including the in the form of responsibility based on an element of error or liability based on fault based on the principle of absolute liability or strict liability and discusses the passengers' efforts against the losses suffered as a result of errors that.
